Instructor & Content Liability Protection Clause

Changes to Training Materials

Participants are responsible for ensuring they rely on current regulatory guidance where compliance is required.

Employer and Group Training Data Tracking

When an employer or organization purchases group training seats on our platform, a designated Group Leader is assigned administrative access. To monitor compliance and course completion, the Group Leader can track employee data, including module progress, course completion status, quiz scores, and certificate generation dates. By enrolling through an employer-provided access code, you acknowledge that this progress data will be shared with your employer.

Certification and Examination Disclaimer

Where the Services provide training related to alcohol service certification:

  • completion of training does not guarantee passing any examination
  • certification requirements are determined by regulatory authorities
  • regulatory agencies may change requirements without notice

The Company is not responsible for examination outcomes, regulatory decisions, or certification eligibility.

Digital Badges

When you purchase a digital badge product from us:

  • An account will be created for you on this site and your data will be added to our badge issuing platform to enable us to manage your badge creation and issuance.
  • Your data will be processed as per the terms and conditions of our badging technology providers.
  • It can take up to 30 working days (and in some cases, more than) to conduct verification checks and customizations for a badge.

Please note: A digital badge is not intended to replace an employer’s own verification of certification or replace compliant proof of certification. It is intended to provide a shareable artefact that you can use to showcase you have a certification, which may be issued by another body and which we have verified, or to showcase a certain skill that we have recognized.

In case of inspection by a regulatory body, such as the Department of Alcoholic Beverage Control, a digital badge cannot be used in place of compliant proof of certification for the server roster during an ABC inspection.

Alcohol Service Responsibility Disclaimer

The training provided by ABC Certified Server Training is intended to promote responsible alcohol service practices within the hospitality industry.

Educational Purpose

All training materials are provided for educational and informational purposes only and are designed to assist participants in understanding commonly recognized responsible alcohol service practices.

Completion of training does not substitute for professional judgment, employer policies, or regulatory compliance obligations.

Individual Responsibility

Participants remain individually responsible for:

  • complying with all applicable alcohol service laws and regulations
  • following the policies of their employer or venue
  • exercising sound judgment when serving alcohol

Responsible alcohol service decisions must always be based on real-time circumstances, applicable laws, and workplace policies.

No Guarantee of Outcomes

Completion of training does not guarantee that:

  • alcohol-related incidents will be prevented
  • alcohol laws will always be correctly interpreted
  • a participant will always make appropriate service decisions

Situations involving alcohol service can be complex and highly dependent on context.

Employer Policies May Differ

Employers, venues, and regulatory authorities may impose requirements that differ from or exceed the practices discussed in training materials.

Participants should follow the most stringent applicable requirements, including those established by:

  • employers
  • licensing authorities
  • local laws and regulations.

Limitation of Responsibility

To the fullest extent permitted by law, ABC Certified Server Training shall not be responsible for any actions, decisions, or consequences arising from the service, sale, or consumption of alcohol by training participants or their employers.

Disclaimer of Warranties

The Services and all training materials are provided “as is” and “as available.”

To the fullest extent permitted by law, ABC Certified Server Training disclaims all warranties, whether express or implied, including but not limited to:

  • warranties of merchantability
  • fitness for a particular purpose
  • non-infringement
  • accuracy or completeness of content

We do not warrant that:

  • the Services will be uninterrupted
  • the platform will be error-free
  • training materials will meet every user’s needs
  • the Services will guarantee regulatory compliance.

Limitation of Liability

To the fullest extent permitted by California law, ABC Certified Server Training shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

  • loss of profits
  • business interruption
  • regulatory penalties
  • employment consequences
  • certification failure

arising from or related to:

  • reliance on training materials
  • inability to access the Services.

In no event shall the Company’s total liability exceed the amount paid by the user for the Services within the preceding twelve (12) months, if any.

Indemnification

You agree to indemnify and hold harmless ABC Certified Server Training, its officers, employees, and affiliates from any claims, damages, or liabilities arising from:

  • your use of the Services
  • your violation of these Terms
  • your failure to comply with applicable alcohol service laws or regulations.
